Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and RumahProp ("Company", "we", "us", "our") governing your use of the RumahProp platform ("Platform").

By registering for an account, subscribing to a plan, or otherwise accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately cease using the Platform.

2. Description of Service

RumahProp is a Software-as-a-Service (SaaS) platform that provides real estate professionals with tools to:

• Monitor and extract property listings from public Telegram channels using AI-powered parsing
• Manage and organise property listings through a centralised dashboard
• Generate a personalised agent-branded subdomain (e.g., yourname.rumahprop.my)
• Access performance reporting and analytics

We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time with reasonable notice.

3. Subscription Plans & Pricing

3.1 Available Plans

The Starter plan is available at RM 50/month for the first 50 subscribers only (Early Bird pricing). After the first 50 spots are filled, the Starter plan reverts to RM 100/month. Pro and Pro Max plans are priced at RM 200/month and RM 350/month respectively.

3.2 Billing

• Subscriptions are billed monthly in advance in Malaysian Ringgit (MYR).
• Payment is due on the same date each month from your subscription start date.
• We accept payment via credit/debit card and any other payment methods listed on the Platform.
• All fees are non-refundable except as expressly stated in Section 3.4.

3.3 Plan Changes

You may upgrade your plan at any time. The upgrade takes effect immediately and you will be charged a pro-rated amount for the remainder of the billing cycle.

3.4 Refund Policy

RumahProp does not offer refunds for partial months of service. If you cancel your subscription, you will retain access to the Platform until the end of your current billing cycle.

3.5 Late Payment & Suspension

If a payment fails, we will retry the charge and notify you by email. If payment remains outstanding after 7 days, your account may be suspended. If outstanding after 30 days, your account may be terminated.

4. Account Registration & Eligibility

• You must be at least 18 years of age to register for and use the Platform.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are fully responsible for all activities that occur under your account.
• You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.
• One person or entity may not maintain more than one free trial account.

5. Telegram Integration & Acceptable Use

5.1 Your Responsibilities

By connecting your Telegram account to RumahProp, you represent and warrant that:

• You are the legitimate and authorised account holder of the Telegram account connected to the Platform.
• You will only monitor public Telegram channels — you will not attempt to access private, restricted, or invite-only channels through the Platform.
• Your use of the Telegram integration complies with Telegram's Terms of Service and all applicable laws.
• You have the right to access and process the content of the channels you choose to monitor.
• You will not use the Platform to scrape, collect, or store personal data of individuals from Telegram channels in violation of PDPA 2010 or any other applicable law.

5.2 Our Role

RumahProp acts solely as a technical tool to assist you in monitoring and organising publicly available property listings. We do not endorse, verify, or take responsibility for the accuracy or legality of any listing content.

6. Branded Subdomain

Subscribers are entitled to one branded subdomain in the format yourname.rumahprop.my. By using this subdomain:

• You acknowledge that the subdomain is hosted on RumahProp's infrastructure and remains our property.
• You may not use the subdomain for any purpose other than promoting your property agency services.
• You may not transfer, sublicense, or sell access to your subdomain.
• Upon termination of your subscription, your subdomain will be deactivated.
• You must not use the subdomain in a way that could damage RumahProp's reputation or mislead users.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable Malaysian or international law
• Attempt to access private Telegram channels, groups, or messages without authorisation
• Scrape, harvest, or collect personal data of third parties without their consent
• Reverse engineer, decompile, or attempt to extract the source code of the Platform
• Resell, sublicense, or provide access to the Platform to third parties without our written consent
• Introduce malicious code, viruses, or interfere with the Platform's infrastructure
• Use automated scripts, bots, or crawlers to access the Platform outside of its intended functionality
• Impersonate another person or entity or misrepresent your affiliation
• Use the Platform to send unsolicited communications (spam) to leads or clients

Violation of these prohibitions may result in immediate account suspension or termination without refund.

8. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, design, trademarks, logos, and content created by RumahProp, are owned by or licensed to RumahProp.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform during your subscription period solely for your internal business purposes.

Listing data extracted through the Platform is owned by the original content creators. RumahProp claims no ownership over third-party listing content.

9. Data & Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We process your personal data and Telegram data in accordance with PDPA 2010.
• We store your Telegram session tokens in encrypted form and never access your private messages.
• You retain ownership of your account data. Upon request, we will provide you with a data export.
• Upon termination, your personal data will be deleted in accordance with our data retention policy.

10. Disclaimers & Limitation of Liability

10.1 No Warranty

The Platform is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the Platform will be error-free, uninterrupted, or meet your specific requirements.

10.2 Limitation of Liability

To the maximum extent permitted by Malaysian law, RumahProp's total liability to you for any claims arising out of or relating to these Terms or the Platform shall not exceed the total fees paid by you in the 3 months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

10.3 Telegram Dependency

RumahProp is not affiliated with Telegram. We are not responsible for any changes to Telegram's API, policies, or functionality that may affect the Platform.

11. Indemnification

You agree to indemnify, defend, and hold harmless RumahProp and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or relating to your use of the Platform or violation of these Terms.

12. Termination

12.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle.

12.2 By Us

We may suspend or terminate your account immediately without notice if:

• You breach any provision of these Terms
• We are required to do so by law or court order
• Your account has been inactive for more than 12 consecutive months on a paid plan
• We reasonably believe your use poses a security risk or legal liability

12.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. We will delete your data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or prominent notice on the Platform at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by the courts of Malaysia.

15. General Provisions

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and RumahProp regarding the Platform.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
• Language: These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version prevails.
